Welcome to Vayroute. We respect your privacy and are committed to protecting your personal data. This privacy policy will inform you as to how we look after your personal data when you visit our website (regardless of where you visit it from) and tell you about your privacy rights and how the law protects you.

2. The Data We Collect About You

Personal data, or personal information, means any information about an individual from which that person can be identified. We may collect, use, store and transfer different kinds of personal data about you which we have grouped together as follows:

  • Identity Data: includes first name, last name, username or similar identifier.
  • Contact Data: includes email address and telephone numbers.
  • Technical Data: includes internet protocol (IP) address, your login data, browser type and version, time zone setting and location, operating system and platform, and other technology on the devices you use to access this website.
  • Profile Data: includes your username and password, your road trip itineraries, preferences, feedback, and survey responses.
  • Usage Data: includes information about how you use our website, products, and services.
  • Trip Data: includes stop locations (coordinates and place names), travel dates, trip duration, number of stops, and user-provided preferences or instructions used by AI features.

3. How We Use Your Personal Data

We will only use your personal data when the law allows us to. Most commonly, we will use your personal data in the following circumstances:

  • Where we need to perform the contract we are about to enter into or have entered into with you (e.g., providing road trip planning features, including AI-powered features you explicitly request).
  • Where it is necessary for our legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests.
  • Where we need to comply with a legal obligation.

4. AI-Powered Features & Third-Party Processing

Vayroute uses artificial intelligence to provide several premium features. This section explains how AI is used, what data is processed, and your rights in relation to these features.

4.1 AI Features

The following features are powered by AI:

  • Scenic Route Planner: Analyzes your route to suggest national parks, viewpoints, coastal roads, and natural landmarks as detour waypoints.
  • Packing List Generator: Generates a personalized packing list based on your destinations, dates, and likely activities.
  • AI Stop Planner: Creates day-by-day activity itineraries for individual stops with real venues and timed schedules.
  • AI Trip Editor: Modifies your trip based on natural-language instructions you provide.
  • Random Trip Generator: Generates a complete road trip based on a starting location.

4.2 Third-Party AI Sub-Processor

These AI features are powered by Google Gemini (provided by Google LLC). Google acts as a sub-processor under our Data Processing Agreement, subject to Google's Data Processing Terms and EU Standard Contractual Clauses for international data transfers.

4.3 Data Shared with AI

When you use an AI feature, the following Trip Data is sent to the AI model:

  • Stop locations (coordinates and place names)
  • Travel dates and trip duration
  • Number of stops and their durations
  • Your explicit instructions or preferences (e.g., "add more beach activities")

Data Minimization: We only transmit the minimum data necessary to provide each feature. Your name, email address, password, payment details, and other personal identifiers are never sent to the AI model.

4.4 Legal Basis

The legal basis for processing your Trip Data through AI features is Performance of a Contract (Article 6(1)(b) GDPR). You actively request these features, and processing is necessary to deliver them. You can choose not to use any AI feature, and your core trip data remains unaffected.

5. Automated Decision-Making (Article 22 GDPR)

Our AI features generate suggestions (routes, packing items, itineraries, trip modifications) but do not make decisions that produce legal or similarly significant effects on you. All AI outputs are recommendations that you can freely modify, ignore, or regenerate.

You have the right to understand the logic behind AI-generated suggestions. Each AI feature in our application includes an in-app explanation (accessible via the ℹ️ icon) describing what the AI does and what data it uses.

6. Affiliate & Recommendation Data

Vayroute displays activity and accommodation recommendations from third-party providers (such as Viator). These recommendations are not based on personal profiling. The main parameters used to rank recommendations are:

  • Geographic proximity to your selected stop
  • User ratings from the third-party platform
  • Price

Recommendation links are affiliate links, meaning Vayroute may earn a commission if you make a purchase. This is disclosed in the application interface. No recommendations are paid placements unless explicitly labeled as "Sponsored."

7. Data Security

We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorized way, altered, or disclosed. In addition, we limit access to your personal data to those employees, agents, contractors, and other third parties who have a business need to know.

8. Data Retention

We will only retain your personal data for as long as reasonably necessary to fulfill the purposes we collected it for, including for the purposes of satisfying any legal, regulatory, tax, accounting, or reporting requirements. We may retain your personal data for a longer period in the event of a complaint or if we reasonably believe there is a prospect of litigation in respect to our relationship with you.

Under certain circumstances, you have rights under data protection laws in relation to your personal data, including the right to:

  • Request access to your personal data.
  • Request correction of your personal data.
  • Request erasure of your personal data.
  • Object to processing of your personal data.

  • Right not to be subject to solely automated decision-making (Article 22 GDPR).
